Terms for Submitting Application
These terms are posted for public viewing and are considered accepted by applicants at time of application whether acknowledgement is formally made or disseminated, regardless how applicant submits application and supporting documents.
Applicant agrees to all of the following terms & conditions along with the privacy & information sharing practices listed in sections (a) through (n) of these terms.
(a) Each person occupying the house aged 18 or older should fill out a separate application.
(b) The cost per application is $58.50 (subject to change) which covers the costs of a criminal credit background check. This can be made payable via check, credit card over the phone with a 3.5% fee or by venmo/paypal at no cost.
(c) By accepting the consent & submitting a lease application, the applicant initiates the release of his or her credit, eviction, bankruptcy and criminal record information to the landlord via Equifax, Transunion, Experian, Missouri State Highway Patrol, Federal Bureau of Investigation, State or local police, and/or private investigator, either directly or by use of third party tenant screening software. By declining, he or she cancels the rental application.
(d) Applicant acknowledges that this application process and subsequent application submittal shall be construed as consumer-initiated, meaning the consumer (renter) plays an active role in deciding when and to whom to release sensitive personal information. Therefore, Applicant agrees to release to KMH Leasing Company, Agents, Managers, and/or other Related Parties, all consumer and criminal reports, even when those reports are considered confidential, for use in the narrow scope of reviewing those reports to determine eligibility for the specific property for which they are applying.
(e) Applicant acknowledges and agrees that application is not marked received until it is paid. Rental decisions are made in order that they are received (and paid). Applications that are received and not paid by Applicant will secede submittal position when supplanted by a different application from other applicants, who submit both the leasing application and payment in full.
(f) By submitting this application, Applicant acknowledges that no agency nor relationship between Applicant and KMH Leasing shall exist, and that unless explicitly stated in writing, KMH Leasing Company, Agents, Managers, and/or other Related Parties, fully and wholly represent the property owner in any leasing transaction. Should Applicant wish to be represented by an agency, broker, leasing agent, attorney, or other qualified person in regards to this transaction, they have the right to do so, at their own cost.
(g) Leasing application fees may be paid via Venmo, Paypal, cash, check, debit card, or credit card. Certain payment methods may be assessed a processing or service charge for each payment transaction, which shall not exceed 5% per transaction. Applicant acknowledges that certain payment methods such as cash, check, credit or debit card may delay the payment submittal process, and are encouraged to use Paypal or Venmo to ensure that the application is paid and recorded with digital timestamp.
(h) Applicant acknowledges and agrees that each person aged 18 or older that is intending to co-occupy the property which Applicant is applying, shall also individually submit an application & payment for the property. Applicant acknowledges that if more than one person aged 18 or older intends to co-occupy the property, the applications shall not be considered received until at which time ALL applicants wishing to co-occupy, have submitted and paid for the application.
(i) Applicant understands that the leasing fee is used to cover the applicants required checks as described in section (c) herein, along with covering the processing and administration from KMH Leasing Company, Agents, Managers, and/or other Related Parties including but not limited to internal screening applicant based on property specific qualifications, and document preparation.
(j) Applicant agrees that this fee is non transferable and shall be used only in conjuction with the specific application submitted for the narrow scope of applying for the property applicant shall list in this submittal form. If Applicant wishes to apply for other propertys held or managed by KMH Leasing Company, Agents, Managers, and/or other Related Parties, applicant should apply for each property individually, and submit separate leasing application fee.
(k) If Applicant or occupants of applicant have accommodations that are needed in conjunction with this application, the leasing process, and /or in the property for which you are applying including but not limited to service or assistance animals, as narrowly defined and determined under HUD Guidance FHEO-2020-01, Applicant will include a written request letter along with any supporting documentation at the time of this application. Applicant Acknowledges that if they do not request accommodations at time of application, they waive certain rights, to the extent permitted by law, withstanding future disability or impairment accomodations requested after application, which are not known to applicant at time of application.
(l) Applicant acknowledges that unless specifically stated in writing, KMH Leasing Company, Agents, and/or Managers shall not hold in escrow, any payment received for security deposits, submitted by applicant at time of lease signing. Security deposits are held in full by the property owners of each individual property.
(m) Applicant acknowledges that unless specifically stated in writing, KMH Leasing Company, Agents, and/or Managers do not own the property you are applying for and are an agent for the property owner. Information disseminated from KMH Leasing Company, Agents, Managers, and/or Related Parties to Applicant is aggregated data from several public sources and/or the property owner. KMH Leasing Company does not further verify the information with exception to those facts that pertain to verifying the properties deed when available, and ensuring that the purported owner is in fact the actual owner, or manager when associated through a corporate or trust holding. Applicant should perform due diligence, and if facts presented, whether in writing or verbally disseminated by KMH Leasing Company, shall be used in applicants decision making process, applicant agrees to verify the information used for decision making process independently. Applicant agrees to indemnify and hold harmless KMH Leasing Company, Agents, Managers, and/or Related Parties for any information disseminated before, during, or after the Applicant submits application, even when information was not materially factual, as long as information was given in good faith.
(n) Applicant understands that by submitting this application, KMH Leasing Company may release sensitive information to third party companies including but not limited to those listed under section (c) for the limited scope of determination & ability for applicant to qualify for property for which was applied. Information shall not be used for marketing purposes. Certain information including any optional reporting data given by applicant, may be aggregated, without identifying information, and be used for reporting to governmental organizations, or when required by law. Applicant can’t opt out of this information sharing. KMH Leasing Company conforms to all laws and regulations regarding to the transmittal of sensitive, personal, and confidential information. Applicant agrees to fully release and indemnify KMH Leasing Company from any data or breach where Applicants information is compromised, and Applicant agrees to not seek compensation for such breach or subsequent actions caused by any party when related to breach, including the applicants waiver of actual and punitive damages. Applicant further understands that should any breach of data occur, upon learning of such breach, KMH Leasing Company, shall inform Applicant in writing to last known address, that breach occured. KMH Leasing Company shall extend to applicant, as a courtesy and for a limited time period of 30 days after KMH Leasing attempts to inform Applicant, professional 3rd party credit monitoring lasting 12 calendar months, when applicant submits request for credit monitoring to principal business address of KMH Leasing Company.
